
LHRC Calls for Legal Reforms Towards a Stronger Consumer Redress Framework in Tanzania
Legal and Human Rights Centre (LHRC) has released a new policy brief titled “Advocating for Legal Reforms Towards a Robust Consumer Redress Framework,” highlighting persistent challenges facing Tanzanian consumers despite recent legislative reforms.
In October 2024, the Fair Competition Act (FCA) of 2003 was amended to grant the Fair Competition Commission (FCC) expanded authority over consumer complaints, an important step in strengthening consumer protection. However, procedural instruments, such as the 2022 Complaint Handling Procedures, have not yet been updated to reflect this expanded mandate. As a result, some complaints are still being referred back to the courts, limiting the effectiveness of the reforms.
The policy brief also reveals that despite FCC’s mandate, public awareness and access remain limited. According to LHRC’s Human Rights and Business Report (2023/24), 35% of Tanzanians reported encountering substandard products, yet only 3% filed complaints with relevant authorities. This gap reflects a systemic disconnect between consumer needs and institutional responses.
To align with international best practices such as the UN Guidelines for Consumer Protection (2015) and the African Model Law on Consumer Protection (1996), LHRC recommends:
1. Updating outdated FCC procedures to match the amended law.
2.Establishing accessible redress mechanisms, such as online platforms and consumer helplines.
3. Expanding public awareness and consumer education campaigns.
4. Ensuring special attention to vulnerable groups in consumer markets.
Countries such as South Africa and the United Kingdom provide useful examples of specialized tribunals, digital complaint systems, and well-publicized helplines that make justice more accessible for consumers.
LHRC stresses that protecting consumer rights requires not only legislative reforms but also practical institutional adjustments to guarantee fair and effective access to justice for all Tanzanians.
