Constitutional Petition Raises Concerns Over Forced Community Policing Participation
On 12th May 2026, the High Court of Tanzania, Main Registry at Dodoma, issued procedural directions in a constitutional petition filed by Meczedeck Maganya challenging several provisions of the Kinondoni Municipal Public Security By-laws of 2002 (G.N No. 385 of 2002).
The petition challenges regulations that require residents to participate in community policing activities either physically or through financial contributions, arguing that the provisions violate constitutional rights including the right to privacy, freedom from forced labour, freedom of expression, and the right to a fair hearing.
During the hearing, the Court directed the respondents to file written submissions by 26th May 2026, while the petitioner is expected to file a reply on 9th June 2026. The matter is scheduled for mention on 18th June 2026.
The case is considered significant as it raises important constitutional questions regarding compulsory participation in community policing and the protection of fundamental human rights and freedoms in Tanzania.
