Kituo cha Sheria na Haki za Binadamu kinaungana na jamii ya ulimwengu kuadhimisha siku ya mtoto wa Afrika ambayo huadhimishwa Juni 16 tangu ilipoainishwa rasmi na Junuiya ya Umoja wa Afrika mwaka 1991.

Katika kuadhimisha siku hii yenye kauli mbiu inayosema “Maendeleo Endelevu 2030: Imarisha Ulinzi na Fursa Sawa kwa Watoto” Kituo cha Sheria na Haki za Binadamu kupitia Ripoti ya Haki za Binadamu 2016 kimebaini changamoto lukuki ambazo zinadumaza ustawi wa watoto nchini Tanzania. Changamoto hizo ni pamoja na:

  1. Kuongezeka kwa vitendo vya ukatili wa kingono dhidi ya watoto ambapo vitendo zaidi ya 2, 571 vya ubakaji na ulawiti vimeripotiwa katika nusu ya kwanza ya mwaka 2016.
  2. Vitendo vya Ukatili wa kingono kufanywa na watu wa karibu kwa watoto; asilimia 49 ya vitendo vya ubakaji na ulawiti kwa watoto vimeripotiwa kutekelezwa na ndugu wa karibu kwa watoto hivyo kupelekea ugumu katika kufuatwa kwa sheria kwani masuluhisho mengi huishia katika ngazi ya familia na wakati mwingine jamii hushindwa kutoa ushahidi kwa kuoneana aibu.
  3. Kuendelea kushamiri kwa ndoa za utotoni; watoto wawili (2) kati ya watano (5) huolewa chini ya miaka 18 na kupelekea kukatisha haki yao ya kupata elimu.
  4. Mimba za utotoni/mashuleni: Ripoti ya Shirika la Umoja wa Mataifa la Idadi ya Watu Duniani (UNFPA) juu ya ongezeko la mimba za utotoni barani Afrika imeitaja Tanzania kuwa nchi inayoongoza kwa mimba za utotoni barani Afrika.
  5. Vitendo vya kikatili na mateso dhidi ya watoto: kupitia vyombo vya habari vitendo vingi vya kikatili ikiwemo adhabu kali na zinazotweza utu wa mtoto vimeripotiwa. Vitendo vya watoto kuunguzwa kwa moto, kupigwa hadi kupelekea majeraha hata kujeruhiwa kwa visu au mapanga vimezidi kuripotiwa kwa kiasi kikubwa.
  6. Ukeketaji: Mbali na takwimu kuonyesha kupungua kwa vitendo vya ukeketaji, bado mila hii potofu imeendelea kurudisha nyuma harakati za kumkomboa mtoto wa kike kutoka katika wimbi la mila potofu.
  7. Vikwazo katika utekelezaji wa Sera ya Elimu Bure: changamoto kadhaa katika utekelezaji wa sera ya elimu bure/elimu bila malipo kupitia Sera ya Elimu na Mafunzo ya mwaka 2014 ikijumuisha shule nyingi zilizidiwa na wanafunzi ukilinganisha na uwepo wa madarasa, upungufu wa walimu na vifaa vya kufundishia vimeendelea kukwaza haki ya watoto kupata elimu bora.
  8. Huduma hafifu za afya: changamoto katika sekta ya huduma za afya ikiwemo upungufu wa asilimia 51 wa wahudumu wa afya, kukosekana kwa madawa na vifaa tiba kumeendelea kuyumbisha ustawi wa watoto.

Sababu kuu ya kuzidi kuongezeka kwa changamoto hizo ni pamoja na sheria kandamizi kama sheria ya ndoa ya mwaka 1971 inayoruhusu msichana kuolewa akiwa na umri chini ya miaka 18; serikali kutenga bajeti duni kwenye huduma za kijamii ikiwemo afya na elimu; umasikini; mila potofu; Imani za kishirikina; uendeshaji mashitaka kucheleweshwa katika vyombo vya utoaji haki; malezi duni kwa watoto; rushwa pamoja na familia na ndugu wa wahanga kujaribu kuficha aibu ndani ya familia.

Kituo chja Sheria na Haki za Binadamu kinapendekeza yafuatayo katika kudumisha ustawi wa watoto nchini Tanzania:

  1. Watanzania kwa ujumla kutambua umuhimu wa kuzingatia haki za mtoto kwa kutowaficha wahalifu wa vitendo vya kikatili dhidi ya watoto na badala yake kuwaibua na kuacha sheria kuchukua mkondo.
  2. Wazazi na walezi kudumisha malezi bora kwa watoto ili kuzuia mmomonyoko wa maadili unaopelekea mmomonyoko wa ustawi kwa watoto.
  3. Jamii kuachana na mila potofu pamoja na Imani za kishirikina zinazokandamiza ustawi wa watoto.
  4. Vyombo vya usimamizi wa sheria ikijumuisha jeshi la polisi na mahakama kuzingatia ustawi wa watoto wakati wa maamuzi na usimamizi wa haki.
  5. Serikali kufanyia marekebisho sheria zote zinazokandamiza ustawi wa watoto ikiwemo sheria ya ndoa yam waka 1971.
  6. Serikali kuboresha sera ya elimu kuwezesha watoto wa kike kuweza kuendelea na masomo baada ya kujifungua.
  7. Serikali kuelekeza nguvu katika kuboresha huduma za kijamii na miundombinu ili kumaliza changamoto zinazowakabili watoto hususani maeneo ya vijijini.

Mwisho, Kituo cha Sheria na Haki za Binadamu kinaamini watoto ni hazina ya taifa lolote lenye dira ya maendeleo hivyo ni wajibu wa kila mmoja kudumisha ulinzi kwa watoto.
